Terms and Conditions

1. Payment - Payment must be by way of credit card through Stripe, the credit card processing company used by Moment Inc. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.  To secure a booking for a group trip, the Company requires that you pay the $400 deposit set forth in the order form.  If there are less than 30 days remaining until the date of your trip, we require full payment of the trip price.  If there are more than 30 days remaining until the date of your trip, you must pay the balance of all monies due no later than 30 days before the scheduled departure date. In the case of non-payment of the balance by the due date we will treat the booking as canceled by you.

2. Itinerary - All published information is accurate to the best of our knowledge at the time of publishing, but please note that changes to our trip itineraries (which can be significant) can and do occur. The Company will make every effort to keep booked travelers informed of any changes, but cannot be held liable for any alterations made to the published itineraries. Please refer to our website for the most recent update to any trip.

3. Cancellation of Your Trip -  We reserve the right to cancel any trip prior to the scheduled departure date for any reason whatsoever, including without limitation, insufficient participation, local weather conditions or logistical problems that, in our sole reasonable judgment, may impede trip operations. In the event we cancel your trip for any reason whatsoever other than a force majeure event, your sole and exclusive remedy shall be the refund of all payment we have received from you as of the date of cancellation, and the payment of the refund shall release us from any and all other or further liability in any way related to such cancellation. We may make substantial payments to its suppliers (hotels, transportation companies, etc.) far in advance of the scheduled trip departure date. Accordingly, if a trip is cancelled due to a force majeure event (e.g. acts of God, war, labor strikes, earthquake, flooding, etc.), we will undertake commercially reasonable efforts to promptly refund the portion of any amounts paid by you that have, in turn, not already been advanced to suppliers. In addition, we will use commercially reasonable efforts to recover and refund to you the balance of your payment amounts that were advanced to suppliers, less the costs, if any, of such recovery, as promptly as possible. However, we do not guarantee recovery of any portion of advance payments made to suppliers. We are not responsible for, and you hereby release and forever discharge us from, any expense or cost incurred by you in preparing for or arising or resulting from a cancelled trip. 

If you cancel your trip, we will refund your deposits as follows:

·      Cancellation 30 days or more prior to trip departure – 100% of your deposit

·      Cancellation less than 30 days prior to departure, or during trip – No refund

4. Insurance - We recommend that you purchase travel insurance that covers adequate personal accident, medical, evacuation and repatriation expenses, as well as cancellation, curtailment, loss of effects and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client.

5. Passports; Visas - You are responsible for being in possession of a valid passport, visa permits, inoculations and preventative medicines as may be required for the duration of the trip. 

6. Limitations on Liability - You acknowledge that participating in our trips requires a degree of flexibility, and understand that the route of a trip, accommodation and modes of transport are subject to change without prior notice due to local circumstances. Should we deem it advisable to amend an itinerary for any reason, it may do so by shortening, varying or re-routing any trip. These changes are binding and additional expenses will be charged to you if the reason for any alteration is outside of our control. While traveling, you agree to accept the authority of the leader and/or local operator at all times. You understand that we reserve the right to decline, accept, or retain any person as a member of the group at any time. You understand and agree that the Company is not liable for any injury including death, damage, loss, delay or irregularity that may occur due to the behavior of any third parties providing services during your trip. None of our employees, contractors, sub-contractors, servants or agents has authority to vary these conditions. 

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU ACKNOWLEDGE AND AGREE THAT THE TRANSPORTATION, HOTEL AND OTHER ACCOMMODATIONS, FOOD, GROUND HANDLING AND OTHER SERVICES (TOGETHER “VENDOR SERVICES”) ARE PURCHASED FROM VARIOUS THIRD-PARTY SUPPLIERS (“VENDORS”), ALL OF WHOM ARE INDEPENDENT CONTRACTORS AND OVER WHOM WE HAVE NO RIGHT OF CONTROL OR AUTHORITY. THE VENDOR SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND BY US. EXCEPT AS EXPRESSLY PROVIDED ABOVE, MOMENT INC. MAKES NO WARRANTIES OF ANY KIND WITH RESPECT TO THE TRIP, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE SHALL NOT BE LIABLE FOR THE ACTS OR OMISSIONS OF ANY VENDOR OR OTHER THIRD PARTY, INCLUDING WITHOUT LIMITATION, ANY DAMAGE, DEATH, LOSS OR INJURY TO PERSON OR PROPERTY CAUSED, IN WHOLE OR IN PART, BY ANY VENDOR OR OTHER THIRD PARTY, NOR THE STANDARD OF CARE YOU RECEIVE IN CONNECTION WITH THE VENDOR SERVICES. IN NO EVENT SHALL MOMENT INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNATIVE OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF WAGES, SAVINGS OR CONSORTIUM, EVEN IF SUCH DAMAGES ARE FORESEEABLE AND WHETHER OR NOT MOMENT INC. HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. MOMENT INC.’S MAXIMUM AGGREGATE LIABILITY, WHETHER ARISING IN TORT, EQUITY, LAW OR CONTRACT, SHALL NOT EXCEED THE TOTAL AMOUNT PAID OR PAYABLE BY YOU TO US IN CONNECTION WITH THE TRIP AT ISSUE.  The limitations set forth in this Section shall not apply where prohibited by law, but instead shall be interpreted to give effect and enforced to the maximum allowable extent.

7. Release - You will be required to sign our standard Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement ("Release Agreement") prior to your trip.  A copy of the Release Agreements is here [add link]. 

8. Privacy - All information provided here is kept completely confidential, and is kept solely to service your order. We do not share, sell or otherwise distribute any information gathered by this ordering system. If you have any questions or concerns regarding your privacy, please contact us.

9. Controlling Law and Severability - These Terms will be governed by and construed in accordance with the laws of the State of Washington, excluding its conflict of law principles. These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If you are a consumer based in the United Kingdom, these Terms will be governed by the laws of the jurisdiction of your residence. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of these Terms shall continue in full force and effect.

10. Right To Make Changes - We reserve the right to make changes to our site, policies, and these Terms and Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

11. Photo / Video Release - I hereby grant to Moment the absolute and irrevocable right and unrestricted permission to use photographic portraits / images / videos in which I feature that are taken during the course of the retreat to use / republish / copyright, etc. for commercial use in association with Moment and its partners for this trip.

I hereby release and discharge Moment from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.
